Opportunity Overview

The subject of this publication is the conclusion of non-exclusive rebate agreements pursuant to Section 130a (8) SGB V for drugs containing the active ingredient Epinephrine (WHO ATC code: C01CA24) in the dosage form of pre-filled syringe/pre-filled pen - exclusive 500 micrograms. The contract conclusion will take place within the framework of a so-called open-house model, meaning that a contract conclusion is open to all interested pharmaceutical companies within the participation period, provided they meet and accept the participation requirements. This results in the fact that individual contract negotiations will not be conducted and no (supply) exclusivity will be granted. It is pointed out that the purchase quantity is unknown, as it depends on demand and the development of the number of insured persons, on the prescribing behavior of doctors, and on the dispensing and stocking behavior of public pharmacies. Minimum purchase quantities are therefore not guaranteed. Interested pharmaceutical manufacturers can download the participation documents via the project room of the German Procurement Portal (DTVP). To do this, an application for access to the project room is required first. After access has been granted by the contracting authority, the participation documents can then be accessed. Absolute confidentiality must be maintained regarding the content of the participation documents - particularly regarding the content of the rebate agreement and the rebates mentioned therein. Full or partial disclosure or making the content of the participation documents accessible to or for third parties requires the prior written consent of the contracting authority. If participation is declined, all documents must be destroyed immediately in a data protection-compliant manner. The documents to be submitted are set out in the "Cover Letter" and "Explanations of Contractual Conditions" documents stored in the project room. Communication, including the submission of participation documents, will be carried out electronically via the DTVP procurement portal; details can be found in the aforementioned documents. Any information to the contrary in the contract notice is due to technical reasons and is not binding. Applications for participation can be submitted for the first time until September 3, 2026. Please refer to the "Submission Deadlines" appendix stored in the project room for all further submission deadlines. If the submission deadline falls on a Saturday, Sunday, or a national public holiday, the next working day shall apply in place of such day. In case of late access, submitted applications for participation will be considered for the next submission deadline. The rebate agreement will end, regardless of the contract conclusion date, no later than September 30, 2027. The contracting authority reserves the right to terminate the open-house procedure prematurely, particularly in the event of the conclusion of exclusive rebate agreements; in this case, the already concluded rebate agreements will end in accordance with the contractual provisions. According to the contracting authority's experience, exclusive rebate agreements usually come into force 8 to 12 months after the publication of the corresponding contract notice in the Supplement to the Official Journal of the European Union.
